Rrjedhimisht, pjes\u00ebmarrja e qytetar\u00ebve n\u00eb proceset vendimmarr\u00ebse \u00ebsht\u00eb me pesh\u00eb t\u00eb madhe n\u00eb promovimin e qeverisjes demokratike, p\u00ebrfshirjen sociale dhe zhvillimin ekonomik, p\u00ebrfshir\u00eb avancimin e t\u00eb drejtave t\u00eb njeriut. E drejta p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb jet\u00ebn publike \u00ebsht\u00eb e r\u00ebnd\u00ebsishme n\u00eb fuqizimin e individ\u00ebve dhe grupeve si dhe \u00ebsht\u00eb nj\u00eb nga element\u00ebt thelb\u00ebsor\u00eb t\u00eb qasjeve t\u00eb bazuara n\u00eb t\u00eb drejtat e njeriut q\u00eb synojn\u00eb eliminimin e margjinalizimit dhe diskriminimit. T\u00eb drejtat e pjes\u00ebmarrjes jan\u00eb t\u00eb lidhura ngusht\u00eb me t\u00eb drejtat tjera t\u00eb njeriut, si\u00e7 jan\u00eb t\u00eb drejtat p\u00ebr asocim dhe bashkim paq\u00ebsor si dhe lirin\u00eb e shprehjes dhe mendimit.<\/p>\n\n\n\n<p>Pjes\u00ebmarrja e qytetar\u00ebve n\u00eb proceset vendimmarr\u00ebse \u00ebsht\u00eb karakteristik\u00eb e shoq\u00ebrive me demokraci funksionale e cila e p\u00ebrmir\u00ebson llogaridh\u00ebnien e autoriteteve duke e ngritur p\u00ebrgjegj\u00ebsin\u00eb e tyre edhe n\u00eb raport me vet kontrat\u00ebn shoq\u00ebrore. Andaj, n\u00eb vendet demokratike \u00ebsht\u00eb arritur pajtueshm\u00ebria n\u00eb lidhje me nevoj\u00ebn p\u00ebr t\u00eb aplikuar mekanizma legjislativ q\u00eb do t\u00eb leht\u00ebsojn\u00eb pjes\u00ebmarrjen e publikut n\u00eb proceset vendimmarr\u00ebse.<\/p>\n\n\n\n<p>Ekziston nj\u00eb spekt\u00ebr i gjer\u00eb i dokumenteve nd\u00ebrkomb\u00ebtare q\u00eb mb\u00ebshtesin t\u00eb drejt\u00ebn e qytetar\u00ebve p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb vendimmarrje e t\u00eb cilat kan\u00eb pasur nj\u00eb ndikim t\u00eb madh n\u00eb t\u00eb drejt\u00ebn e brendshme t\u00eb shum\u00eb vendeve, p\u00ebrfshir\u00eb edhe Kosov\u00ebn. Shum\u00eb nga k\u00ebto dokumente kan\u00eb aplikueshm\u00ebri t\u00eb drejt\u00ebp\u00ebrdrejt n\u00eb Kosov\u00eb: Deklarata Universale e t\u00eb Drejtave t\u00eb Njeriut, Pakti Nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb Drejtat Civile dhe Politike, Konventa p\u00ebr Zhdukjen e t\u00eb Gjitha Formave t\u00eb Diskriminimit Racor, Konventa p\u00ebr eliminimin e t\u00eb gjitha formave t\u00eb diskriminimit ndaj grave, Konventa Evropiane p\u00ebr Mbrojtjen e t\u00eb Drejtave t\u00eb Njeriut dhe Lirive Themelore, etj.<\/p>\n\n\n\n<p>P\u00ebrkund\u00ebr se \u00ebsht\u00eb nj\u00eb demokraci e re, Kosova ka nj\u00eb korniz\u00eb ligjore progresive q\u00eb \u00ebsht\u00eb zhvilluar me mb\u00ebshtetje t\u00eb fuqishme t\u00eb bashk\u00ebsis\u00eb nd\u00ebrkomb\u00ebtare, ku shumica e instrumenteve nd\u00ebrkomb\u00ebtare q\u00eb mbrojn\u00eb t\u00eb drejtat e njeriut p\u00ebrfshihen n\u00eb korniz\u00ebn ekzistuese ligjore. Rrjedhimisht, e drejta p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb vendimmarrje \u00ebsht\u00eb e p\u00ebrfshir\u00eb n\u00eb dispozitat e Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, Ligjit p\u00ebr Vet\u00ebqeverisjen Lokale, Ligjit p\u00ebr Fuqizimin dhe Pjes\u00ebmarrjen e t\u00eb Rinjve, Udh\u00ebzimit Administrativ p\u00ebr Transparenc\u00ebn n\u00eb Komun\u00eb, Udh\u00ebzimit Administrativ mbi Standardet minimale t\u00eb Konsultimeve Publike n\u00eb Komuna, Udh\u00ebzimit Administrativ p\u00ebr Memorandume t\u00eb Bashk\u00ebpunimit t\u00eb Komunave me fshatra, Udh\u00ebzimit administrativ p\u00ebr procedur\u00ebn e themelimit\/organizimit dhe kompetencave t\u00eb komiteteve konsultative n\u00eb komuna, Statutit t\u00eb Komunave, etj.<\/p>\n\n\n\n<p>Edhe p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje, sikur edhe shum\u00eb t\u00eb tjera, zbatueshm\u00ebria e k\u00ebsaj baze ligjore \u00ebsht\u00eb jo e k\u00ebnaqshme. Shpesh, moszbatimi \u00ebsht\u00eb arsyetuar nga autoritetet p\u00ebr munges\u00eb t\u00eb mjeteve financiare apo edhe si pasoj\u00eb e munges\u00ebs s\u00eb interesimit t\u00eb qytetar\u00ebve p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb proceset vendimmarr\u00ebse.<\/p>\n\n\n\n<p>\u00cbsht\u00eb m\u00ebse evidente se p\u00ebrfshirja e qytetar\u00ebve n\u00eb proceset vendimmarr\u00ebse nuk \u00ebsht\u00eb \u00e7\u00ebshtje e vullnetit t\u00eb institucioneve politike dhe atyre administrative por \u00ebsht\u00eb e drejt\u00eb e patjet\u00ebrsueshme e cila fuqimisht garantohet me dispozita ligjore.&nbsp;<\/p>\n\n\n\n<p><strong>Praktikat e pjes\u00ebmarrjes s\u00eb qytetar\u00ebve n\u00eb vendimmarrje n\u00eb Kosov\u00eb<\/strong><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Nj\u00eb ve\u00e7ori e \u00e7uditshme n\u00eb Kosov\u00eb, n\u00eb periudh\u00ebn e pasluft\u00ebs, \u00ebsht\u00eb edhe mungesa e aktivizmit qytetar duke pretenduar se t\u00eb gjitha nevojat dhe problemet duhet t\u00eb jen\u00eb t\u00eb njohura nga pushteti dhe t\u00eb adresohen me automatiz\u00ebm. Nj\u00eb gj\u00eb e till\u00eb \u00ebsht\u00eb e pamundur edhe n\u00eb vendet me demokraci t\u00eb p\u00ebrparuar. Nd\u00ebrsa n\u00eb vendet e dala nga lufta dhe t\u00eb cilat p\u00ebrpiqen t\u00eb konsolidojn\u00eb sistemin demokratik k\u00ebrkohet nj\u00eb aktiviz\u00ebm i shtuar qytetar p\u00ebr t\u00eb adresuar nevojat dhe prioritetet e bashk\u00ebsis\u00eb. Realisht, n\u00eb Kosov\u00eb jan\u00eb krijuar mekanizma t\u00eb ndrysh\u00ebm q\u00eb inkurajojn\u00eb p\u00ebrfshirjen e qytetar\u00ebve n\u00eb vendimmarrje. K\u00ebta mekanizma jan\u00eb larg prej t\u00eb qenit t\u00eb konsoliduar dhe plot\u00ebsisht funksional edhe pse jan\u00eb t\u00eb nj\u00eb r\u00ebnd\u00ebsie t\u00eb madhe p\u00ebr tranzicionin e vendit drejt nj\u00eb shoq\u00ebrie me vlera demokratike.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Sidoqoft\u00eb, p\u00ebrparime t\u00eb vogla jan\u00eb arritur n\u00eb p\u00ebrfshirjen e qytetar\u00ebve n\u00eb proceset vendimmarr\u00ebse. Fillimisht, infrastruktura ligjore \u00ebsht\u00eb e pranishme si dhe organet administrative q\u00eb jan\u00eb p\u00ebrgjegj\u00ebse p\u00ebr p\u00ebrfshirjen e qytetar\u00ebve n\u00eb vendimmarrje. Mir\u00ebpo, v\u00ebshtir\u00ebsit\u00eb jan\u00eb t\u00eb m\u00ebdha n\u00eb jet\u00ebsimin e k\u00ebtij procesi. Qytetar\u00ebt, p\u00ebr arsye nga m\u00eb t\u00eb ndryshme, nuk shprehin interesim p\u00ebr k\u00ebt\u00eb proces. N\u00eb komun\u00ebn e Vushtrris\u00eb dhe Mitrovic\u00ebs gjat\u00eb vitit 2018 dhe 2019 jan\u00eb organizuar nj\u00eb mori debatesh lidhur me draft politikat komunale me \u00e7\u2019rast nj\u00eb num\u00ebr tejet simbolik i qytetar\u00ebve kan\u00eb shprehur interesim p\u00ebr pjes\u00ebmarrje duke mos arritur q\u00eb t\u00eb merren sugjerime dhe komente konstruktive q\u00eb do t\u00eb ndihmonin n\u00eb cil\u00ebsin\u00eb e politikave publike dhe rrjedhimisht n\u00eb vendimmarrje n\u00eb nivel komunal. Zakonisht gjat\u00eb mbajtjes s\u00eb debateve publike v\u00ebrehet nj\u00eb prezenc\u00eb e moderuar e Organizatave Joqeveritare t\u00eb cilat kan\u00eb nj\u00eb ekspertiz\u00eb lidhur me \u00e7\u00ebshtjet q\u00eb shtrohen p\u00ebr debat. Qytetar\u00ebt marrin pjes\u00eb n\u00eb k\u00ebto takime publike tejet rrall\u00eb dhe zakonisht jan\u00eb grupe t\u00eb tyre q\u00eb nuk i japin ndonj\u00eb vler\u00eb t\u00eb shtuar konsultimit. Organizatat e Shoq\u00ebris\u00eb Civile mund t\u00eb ndihmojn\u00eb lidhur me k\u00ebt\u00eb \u00e7\u00ebshtje duke mobilizuar kapacitetet e tyre n\u00eb vet\u00ebdij\u00ebsimin e qytetar\u00ebve lidhur me r\u00ebnd\u00ebsin\u00eb e pjes\u00ebmarrjes n\u00eb procese vendimmarr\u00ebse. Shkaktarin kryesor t\u00eb k\u00ebsaj dukurie duhet k\u00ebrkuar te mend\u00ebsia e form\u00ebsuar gjat\u00eb sistemit t\u00eb kaluar kur asnj\u00ebher\u00eb nuk \u00ebsht\u00eb sfiduar vendimmarrja e autoriteteve, si dhe me perceptimin e qytetar\u00ebve se nuk kan\u00eb mund\u00ebsi t\u00eb ndikojn\u00eb n\u00eb vendimmarrje n\u00eb nivel komunal.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Strukturat e ashtuquajtura n\u00ebn komunale t\u00eb organizimit t\u00eb qeverisjes kan\u00eb qen\u00eb dhe vazhdojn\u00eb t\u00eb jen\u00eb nd\u00ebr format m\u00eb t\u00eb sigurta t\u00eb afrimit t\u00eb qytetar\u00ebve me proceset e vendimmarrjes n\u00eb komun\u00eb. Niveli n\u00ebn komunal i organizimit t\u00eb qeverisjes n\u00eb Kosov\u00eb haset me em\u00ebrtime t\u00eb ndryshme: diku njihet si k\u00ebshill lokal e diku tjet\u00ebr si k\u00ebshill i fshatit. Roli i k\u00ebshillave t\u00eb fshatrave lidhet kryesisht me shqyrtimin e \u00e7\u00ebshtjeve n\u00eb interes t\u00eb lokalitetit; planifikimin, organizimin dhe p\u00ebrcjelljen e planeve dhe programeve zhvillimore t\u00eb lokalitetit; organizimin e takimeve t\u00eb qytetar\u00ebve me zyrtar\u00eb komunal\u00eb; etj. Megjithat\u00eb, nj\u00eb nga sfidat m\u00eb t\u00eb m\u00ebdha t\u00eb funksionalizimit t\u00eb k\u00ebshillave t\u00eb fshatrave n\u00eb Kosov\u00eb mbetet financimi i k\u00ebtyre mekanizmave. Meqen\u00ebse n\u00eb aspektin ligjor k\u00ebto organe nuk njihen si kategori ligjore e qeverisjes n\u00ebn komunale, problematik\u00eb e pakap\u00ebrcyeshme mbetet financimi i funksionimit t\u00eb k\u00ebtyre trupave. Andaj, komunat jan\u00eb t\u00eb detyruara t\u00eb gjejn\u00eb forma t\u00eb ndryshme t\u00eb financimit p\u00ebr t\u00eb siguruar q\u00eb k\u00ebshillat e fshatrave t\u00eb funksionojn\u00eb.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; K\u00ebshillat e fshatrave, padyshim, jan\u00eb mekanizma tejet t\u00eb r\u00ebnd\u00ebsish\u00ebm t\u00eb p\u00ebrfshirjes s\u00eb qytetar\u00ebve n\u00eb proceset vendimmarr\u00ebse n\u00eb nivel lokal. P\u00ebrmes tyre, nevojat dhe prioritetet e banor\u00ebve artikulohen n\u00eb m\u00ebnyr\u00eb m\u00eb t\u00eb strukturuar dhe garantojn\u00eb efikasitet m\u00eb t\u00eb lart\u00eb n\u00eb adresimin e problemeve. Mir\u00ebpo k\u00ebto k\u00ebshilla t\u00eb fshatrave, p\u00ebrkund\u00ebr obligimit ligjor, n\u00eb disa komuna ende nuk jan\u00eb t\u00eb formuara nd\u00ebrsa n\u00eb disa tjera jan\u00eb pothuajse jofunksionale. Zbehja e dukshme e funksionimit t\u00eb k\u00ebshillave t\u00eb fshatrave \u00ebsht\u00eb shkaktuar nga mungesa e p\u00ebrkrahjes financiare dhe logjistike nga ana e pushtetit lokal. P\u00ebr k\u00ebt\u00eb arsye, p\u00ebrfaq\u00ebsuesit e k\u00ebshillave kan\u00eb konsideruar se jan\u00eb neglizhuar nga autoritetet komunale duke e minimizuar rolin e tyre. Megjithat\u00eb, aktet n\u00ebnligjore t\u00eb miratuara gjat\u00eb vitit 2019 lidhur me bashk\u00ebpunimin mes komun\u00ebs dhe k\u00ebshillave t\u00eb fshatrave kan\u00eb ofruar zgjidhje t\u00eb pjesshme rreth \u00e7\u00ebshtjes n\u00eb fjal\u00eb duke p\u00ebrcaktuar taksativisht detyrimin e pushtetit lokal p\u00ebr t\u00eb p\u00ebrkrahur k\u00ebto k\u00ebshilla edhe financiarisht. Nga ana tjet\u00ebr, qytetar\u00ebt kan\u00eb njohuri tejet t\u00eb vogla rreth rolit dhe r\u00ebnd\u00ebsis\u00eb s\u00eb k\u00ebshillave t\u00eb fshatrave duke p\u00ebrfshir\u00eb edhe kompetencat e tyre t\u00eb garantuara me dispozita ligjore. Jo rrall\u00eb, k\u00ebto k\u00ebshilla keqp\u00ebrdoren nga subjektet politike ekskluzivisht p\u00ebr arritjen e objektivave ditore politike. Andaj, besueshm\u00ebria e tyre n\u00eb raport me qytetar\u00ebt \u00ebsht\u00eb mjaft e l\u00ebkundur.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Deri m\u00eb tani, shumica e komunave t\u00eb Kosov\u00ebs kan\u00eb anashkaluar p\u00ebrfshirjen e grupeve t\u00eb caktuara shoq\u00ebrore n\u00eb vendimmarrje, sidomos kur \u00ebsht\u00eb fjala te buxhetimi komunal p\u00ebr nevojat e t\u00eb rinjve, grave dhe personave me aft\u00ebsi t\u00eb kufizuar. P\u00ebrkund\u00ebr faktit q\u00eb k\u00ebto grupe t\u00eb p\u00ebrmendura jan\u00eb t\u00eb organizuara edhe n\u00eb grupime formale ato nuk kan\u00eb arritur t\u00eb ndikojn\u00eb mjaftuesh\u00ebm n\u00eb buxhetim sipas nevojave t\u00eb tyre. Adresimi i nevojave t\u00eb rinis\u00eb \u00ebsht\u00eb anashkaluar me arsyetimin e vazhduesh\u00ebm t\u00eb munges\u00ebs s\u00eb fondeve andaj kjo kategori ndjehet tejet e margjinalizuar n\u00eb pjes\u00ebn m\u00eb t\u00eb madhe t\u00eb komunave t\u00eb Kosov\u00ebs, me theks t\u00eb ve\u00e7ant\u00eb n\u00eb rajonin e Mitrovic\u00ebs. P\u00ebr m\u00eb tep\u00ebr, ekziston nj\u00eb tendenc\u00eb e instrumentalizimit t\u00eb nj\u00eb numri t\u00eb t\u00eb rinjve nga autoritetet lokale.&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Nj\u00eb nga mekanizmat e krijuar p\u00ebr t\u00eb ngritur pjes\u00ebmarrjen e qytetar\u00ebve n\u00eb proceset vendimmarr\u00ebse \u00ebsht\u00eb edhe krijimi i Komiteteve Konsultative n\u00eb p\u00ebrb\u00ebrje t\u00eb qytetar\u00ebve dhe shoq\u00ebris\u00eb civile. K\u00ebto komitete kan\u00eb t\u00eb drejt\u00eb t\u00eb b\u00ebjn\u00eb hulumtime, mbledhin t\u00eb dh\u00ebna p\u00ebr \u00e7\u00ebshtje tematike dhe t\u2019i propozojn\u00eb administrat\u00ebs komunale adresimin e nevojave t\u00eb qytetar\u00ebve. K\u00ebto komitete funksionojn\u00eb pjes\u00ebrisht dhe n\u00eb num\u00ebr tejet t\u00eb vog\u00ebl n\u00ebp\u00ebr komunat e ndryshme. Shkaku kryesor i mos funksionimit t\u00eb Komiteteve Konsultative \u00ebsht\u00eb mungesa e p\u00ebrkrahjes financiare dhe logjistike p\u00ebr k\u00ebto mekanizma. <em>&nbsp;<\/em><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; N\u00eb nj\u00eb anket\u00eb t\u00eb zhvilluar n\u00eb fillim t\u00eb vitit 2020 (Mitrovic\u00eb dhe Vushtrri) pjesa d\u00ebrmuese e qytetar\u00ebve t\u00eb anketuar (74 %) nuk kan\u00eb shprehur vullnet q\u00eb t\u00eb marrin pjes\u00eb n\u00eb konsultime publike dhe as q\u00eb kan\u00eb marr\u00eb pjes\u00eb n\u00eb ndonj\u00eb konsultim t\u00eb till\u00eb (Hulumtimi \u00ebsht\u00eb zhvilluar nga Avni H. Alidemaj gjat\u00eb vitit 2020 me \u00e7\u2019rast jan\u00eb anketuar 314 qytetar\u00eb t\u00eb Mitrovic\u00ebs dhe Vushtrris\u00eb). Nga ana tjet\u00ebr, p\u00ebrfshirja e qytetar\u00ebve n\u00eb vendimmarrje \u00ebsht\u00eb nj\u00eb nga kriteret thelb\u00ebsore t\u00eb reform\u00ebs s\u00eb administrat\u00ebs publike e cila siguron qeverisje t\u00eb mir\u00eb. Deri m\u00eb tani, infrastruktura ligjore p\u00ebr p\u00ebrfshirjen e qytetar\u00ebve n\u00eb vendimmarrje garanton mekanizma funksional por kjo ka mbetur vet\u00ebm n\u00eb let\u00ebr.
