Pajtimi duhet t\u00eb shoq\u00ebrohet me drejt\u00ebsi; p\u00ebrndryshe nuk do t\u00eb zgjas\u00eb. Nd\u00ebrsa t\u00eb gjith\u00eb shpresojm\u00eb p\u00ebr paqe, kjo nuk duhet t\u00eb jet\u00eb paqe me \u00e7do kusht por paqe e bazuar n\u00eb parime, n\u00eb drejt\u00ebsi&#8221;, tha ish-presidentja e Filipineve Maria Corazon Cojuangco-Aquino.<\/p>\n\n\n\n<p>Natyrisht, pyes veten: \u00e7ka kan\u00eb b\u00ebr\u00eb institucionet e Kosov\u00ebs p\u00ebr t\u00eb siguruar q\u00eb viktimat e krimeve gjat\u00eb luft\u00ebs t\u00eb marrin kompensimin e duhur financiar dhe moral, si dhe drejt\u00ebsi?<\/p>\n\n\n\n<p>N\u00eb demokracit\u00eb e zhvilluara bashk\u00ebkohore, drejt\u00ebsia \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi e institucioneve publike (legjislativit, ekzekutivit dhe gjyq\u00ebsorit), t\u00eb cil\u00ebt jan\u00eb p\u00ebrgjegj\u00ebse p\u00ebr t\u00eb siguruar garantimin e paqes s\u00eb q\u00ebndrueshme dhe afatgjat\u00eb. Pa institucione q\u00eb sigurojn\u00eb paqe dhe stabilitet, gjasat p\u00ebr p\u00ebrs\u00ebritje t\u00eb keq b\u00ebrjeve jan\u00eb t\u00eb m\u00ebdha, dhe shoq\u00ebria mund t\u00eb bjer\u00eb n\u00eb cik\u00ebl dhune, krimi dhe hakmarrjeje. P\u00ebrplasja e vazhdueshme \u00e7on n\u00eb konflikte, luft\u00ebra dhe mizori q\u00eb sjellin vuajtje dhe humbje njer\u00ebzore. Prandaj institucionet publike duhet t\u00eb sigurohen q\u00eb burimet t\u00eb ndahen dhe alokohen p\u00ebr t\u00eb varf\u00ebrit dhe nevojtar\u00ebt, por edhe t\u00eb adresojn\u00eb pabarazit\u00eb dhe krimet brenda kufijve t\u00eb tyre. Duke siguruar drejt\u00ebsi p\u00ebr viktimat, sigurohet stabiliteti politik, respektohen t\u00eb drejtat e njer\u00ebzve, dhe k\u00ebsisoj rritet besimi i tyre n\u00eb sistemin politik.&nbsp;<\/p>\n\n\n\n<p>Gjat\u00eb p\u00ebrvoj\u00ebs sime t\u00eb pun\u00ebs n\u00eb 15 vitet e fundit n\u00eb fush\u00ebn e t\u00eb drejtave t\u00eb njeriut dhe iniciativave t\u00eb komunitetit, u b\u00eb e qart\u00eb p\u00ebr mua personalisht se pajtimi midis komuniteteve \u00ebsht\u00eb jasht\u00ebzakonisht problematik dhe nj\u00eb nd\u00ebrmarrje komplekse. Kjo ndodh sepse shoq\u00ebria kosovare \u00ebsht\u00eb shum\u00eb e ndar\u00eb n\u00eb aspektin etnik. N\u00eb krahasim me f\u00ebmij\u00ebrin\u00eb time, kur isha gjasht\u00eb vje\u00e7, un\u00eb flisja rrjedhsh\u00ebm serbisht dhe takohesha \u00e7do dit\u00eb me komunitete t\u00eb ndryshme. Sot, f\u00ebmij\u00ebt e t\u00eb gjitha komuniteteve nuk kan\u00eb forma praktike t\u00eb bashk\u00ebpunimit dhe bashk\u00ebveprimit. Shkollat fillore dhe t\u00eb mesme n\u00eb Kosov\u00eb r\u00ebndom jan\u00eb t\u00eb ndara, dhe n\u00eb rastet kur komunitetet ndajn\u00eb hap\u00ebsira t\u00eb p\u00ebrbashk\u00ebta, nuk organizohen aktivitete t\u00eb p\u00ebrbashk\u00ebta. Me ngjarje kryesisht sporadike, organizatat nd\u00ebrkomb\u00ebtare realizojn\u00eb ngjarje dhe veprimtari nd\u00ebrveprimi midis komuniteteve pa hapa t\u00eb duhur p\u00ebrcjell\u00ebs. T\u00eb dy sistemet e arsimit (kosovar dhe serb) faktikisht nuk kan\u00eb interes p\u00ebr bashk\u00ebpunim praktik dhe angazhim t\u00eb mundsh\u00ebm midis f\u00ebmij\u00ebve dhe nx\u00ebn\u00ebsve. Un\u00eb kam qen\u00eb pjes\u00eb e organizimit t\u00eb aktiviteteve t\u00eb ngjashme t\u00eb ndjeshme. Di nj\u00eb rast kur nj\u00eb drejtor i komunitetit \u00ebsht\u00eb p\u00ebrjashtuar nga puna vet\u00ebm sepse &#8216;ata&#8217; bashk\u00ebpunuan me institucionet e Kosov\u00ebs n\u00eb organizimin e aktiviteteve t\u00eb lira me f\u00ebmij\u00eb t\u00eb komuniteteve t\u00eb ndryshme. Iniciativat e bashk\u00ebpunimit midis t\u00eb rinjve dhe komuniteteve n\u00eb Kosov\u00eb jan\u00eb p\u00ebrgjith\u00ebsisht jet\u00ebshkurtra, pasi p\u00ebrgjith\u00ebsisht, nuk ka p\u00ebrpjekje serioze q\u00eb ato t\u00eb jen\u00eb t\u00eb q\u00ebndrueshme dhe funksionale.<\/p>\n\n\n\n<p>N\u00eb p\u00ebrgjith\u00ebsi, organizatat nd\u00ebrkomb\u00ebtare n\u00eb Kosov\u00eb mendojn\u00eb se pajtimi \u00ebsht\u00eb \u00e7\u00ebshtje jasht\u00ebzakonisht e ndjeshme dhe hezitojn\u00eb ta quajn\u00eb me emrin q\u00eb e meriton. Andaj pyes veten: pse t\u00eb mbahen aktivitete q\u00eb synojn\u00eb pajtimin pa p\u00ebrmendur si\u00e7 duhet pajtimin? N\u00ebse pajtimi nuk \u00ebsht\u00eb problem, kush do t\u00eb pajtohet? \u00c7&#8217;far\u00eb kemi p\u00ebr t\u00eb fshehur? Asgj\u00eb, do t\u00eb thosha un\u00eb. N\u00ebse pajtimi nuk p\u00ebrmendet si problem \u2013 problemi nuk ekziston. T\u00eb gjith\u00eb do t\u00eb d\u00ebshironim t\u00eb dinim t\u00eb v\u00ebrtet\u00ebn, dhe duke e ditur t\u00eb v\u00ebrtet\u00ebn dhe duke folur hapur p\u00ebr t\u00eb, gjasat e pajtimit do t\u00eb ishin m\u00eb t\u00eb m\u00ebdha. <\/p>\n\n\n\n<p>Duke e anashkaluar, politizuar, ose duke u p\u00ebrmbajtur nga em\u00ebrtimi i k\u00ebtij procesi, do t\u00eb ishte e pamundur t\u00eb trajtojm\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje t\u00eb ndjeshme; tekembramja, pajtimi nuk \u00ebsht\u00eb proces ku rezultati \u00ebsht\u00eb faj\u00ebsimi i <strong>TJETRIT<\/strong> p\u00ebr at\u00eb q\u00eb ka ndodhur. Pajtimi duhet t\u00eb jet\u00eb proces ku pal\u00ebt zhvillojn\u00eb ndjeshm\u00ebri, dhembshuri, diskutojn\u00eb, bien dakord, debatojn\u00eb dhe ecin p\u00ebrpara, duke shpresuar q\u00eb krimet e kryera t\u00eb mos p\u00ebrs\u00ebriten.&nbsp;&nbsp;<\/p>\n\n\n\n<p>P\u00ebrfundimi i luft\u00ebs n\u00eb Kosov\u00eb, n\u00eb kuptimin praktik, nuk i dha fund konfliktit dhe ne pajtohemi se nuk ka pasur konflikt t\u00eb p\u00ebrhapur n\u00eb Kosov\u00eb pas vitit 1999 (duke p\u00ebrjashtuar trazirat e marsit 2004). Sa i p\u00ebrket pajtimit t\u00eb duhur \u2013 e disa autor\u00eb thon\u00eb se k\u00ebrkohen marr\u00ebdh\u00ebnie m\u00eb t\u00eb thella q\u00eb p\u00ebrfshijn\u00eb besimin e nd\u00ebrsjell\u00eb p\u00ebr t\u00eb arritur pajtimin e plot\u00eb \u2013 n\u00eb Kosov\u00eb nuk ka ndodhur ndonj\u00eb gj\u00eb. Ndarja etnike vet\u00ebm sa \u00ebsht\u00eb thelluar. Pas luft\u00ebs, ndarjet etnike dhe mosbesimi jan\u00eb rritur p\u00ebr shkak t\u00eb disa arsyeve. Nj\u00ebra prej tyre \u00ebsht\u00eb p\u00ebr shkak t\u00eb disa shoq\u00ebrimeve midis t\u00eb rinjve dhe komuniteteve \u2013 t\u00eb rinjt\u00eb shqiptar\u00eb t\u00eb Kosov\u00ebs flisnin gjuh\u00ebn serbe krahasuar me periudh\u00ebn pas luft\u00ebs. Forumet e vetme praktike ku b\u00ebhen bashk\u00eb t\u00eb rinjt\u00eb shqiptar\u00eb dhe serb\u00eb t\u00eb Kosov\u00ebs jan\u00eb ngjarjet sporadike t\u00eb organizuara nga organizata nd\u00ebrkomb\u00ebtare ose festime t\u00eb organizuara nga partner\u00eb t\u00eb jasht\u00ebm.<\/p>\n\n\n\n<p>Do t\u00eb pajtohesha me z. Kelman n\u00eb argumentet e tij te <em>&#8220;Zgjidhja e konfliktit dhe pajtimi: perspektiv\u00eb socialo-psikologjike mbi p\u00ebrfundimin e konfliktit t\u00eb dhunsh\u00ebm midis grupeve t\u00eb identitetit<\/em>&#8220;, ku thot\u00eb se p\u00ebr pajtimin duhet t\u00eb ekzistojn\u00eb pes\u00eb parime themelore, pes\u00eb parime q\u00eb Kosova duhet t&#8217;i p\u00ebrvet\u00ebsoj\u00eb n\u00eb k\u00ebt\u00eb proces:<\/p>\n\n\n\n<ol type=\"1\"><li>Pranimi i nd\u00ebrsjell\u00eb i p\u00ebrkat\u00ebsis\u00eb komb\u00ebtare dhe humanitetit t\u00eb tjetrit;<\/li><li>Zhvillimi i nj\u00eb baze t\u00eb p\u00ebrbashk\u00ebt morale p\u00ebr paqen, duke mund\u00ebsuar nj\u00eb paqe q\u00eb t\u00eb dyja pal\u00ebt e shohin n\u00eb p\u00ebrputhje me parimet e barazis\u00eb dhe drejt\u00ebsis\u00eb s\u00eb arritshme;<\/li><li>P\u00ebrballja me historin\u00eb, e cila nuk k\u00ebrkon histori t\u00eb p\u00ebrbashk\u00ebt konsensuale, por k\u00ebrkon pranimin e s\u00eb v\u00ebrtet\u00ebs s\u00eb tjetrit n\u00eb narrativ\u00ebn e vet;<\/li><li>Njohja e p\u00ebrgjegj\u00ebsis\u00eb e shprehur n\u00eb kuptimin simbolik dhe material;<\/li><li>Gjetja e modeleve dhe mekanizmave institucional\u00eb t\u00eb bashk\u00ebpunimit, p\u00ebrfshir\u00eb aktivitete t\u00eb ndryshme sy m\u00eb sy q\u00eb jan\u00eb v\u00ebrtet t\u00eb dobishme p\u00ebr t\u00eb dy pal\u00ebt dhe t\u00eb bazuara n\u00eb barazi dhe reciprocitet.<\/li><\/ol>\n\n\n\n<p>Q\u00eb nga viti 1999, iniciativat sporadike dhe joadekuate jan\u00eb realizuar pa dobi, ve\u00e7an\u00ebrisht dialogu Prishtin\u00eb-Beograd i leht\u00ebsuar nga Bashkimi Evropian (deri m\u00eb sot, p\u00ebrpjekje e d\u00ebshtuar p\u00ebr t\u00eb normalizuar marr\u00ebdh\u00ebniet mes Kosov\u00ebs dhe Serbis\u00eb). Mund t\u00eb thosha se Bashkimi Evropian ka leht\u00ebsuar bisedimet q\u00eb kan\u00eb krijuar tensione midis komuniteteve t\u00eb Kosov\u00ebs n\u00eb disa raste. Kjo vlen sidomos p\u00ebr themelimin e mundsh\u00ebm t\u00eb Asociacionit t\u00eb Komunave Serbe n\u00eb Kosov\u00eb, t\u00eb cilin shqiptar\u00ebt e Kosov\u00ebs e shohin si marr\u00ebveshje korniz\u00eb q\u00eb ndan vendin dhe nuk ndihmon n\u00eb normalizimin e marr\u00ebdh\u00ebnieve midis komuniteteve. Nga ana tjet\u00ebr, serb\u00ebt e Kosov\u00ebs e shohin Asociacionin si m\u00ebnyr\u00ebn e vetme p\u00ebrpara p\u00ebr &#8216;mbijetes\u00ebn&#8217; e tyre n\u00eb Kosov\u00eb.&nbsp;<\/p>\n\n\n\n<p>Rajoni i ish-Jugosllavis\u00eb ka nj\u00eb histori konfliktesh dhe mizorish t\u00eb kryera gjat\u00eb luft\u00ebrave t\u00eb viteve &#8217;90 dhe, n\u00eb adresimin e k\u00ebtyre krimeve, u krijua Tribunali Nd\u00ebrkomb\u00ebtar i Krimeve p\u00ebr ish-Jugosllavin\u00eb (ICTY). Krijimi i tij u pa p\u00ebrgjith\u00ebsisht si paaft\u00ebsi e kapaciteteve t\u00eb ish-shtetit jugosllav apo si munges\u00eb e gatishm\u00ebris\u00eb p\u00ebr t\u00eb adresuar k\u00ebto mizori t\u00eb r\u00ebnda.<\/p>\n\n\n\n<p>Shum\u00ebkush gjithashtu v\u00eb n\u00eb dyshim suksesin e ICTY-s\u00eb p\u00ebr vendosjen e drejt\u00ebsis\u00eb p\u00ebr viktimat e luft\u00ebrave n\u00eb ish-Jugosllavi, e t\u00eb mos flasim p\u00ebr pajtimin. N\u00eb rastin e Kosov\u00ebs, Misioni i Kombeve t\u00eb Bashkuara n\u00eb Kosov\u00eb dhe Misioni i Bashkimit Evropian p\u00ebr Sundimin e Ligjit gjithashtu luajt\u00ebn rol n\u00eb hetimin e mizorive gjat\u00eb luft\u00ebs. N\u00eb nivel global, n\u00eb rast t\u00eb mizorive masive, shtetet dhe komunitetet jan\u00eb marr\u00eb n\u00eb m\u00ebnyra t\u00eb ndryshme me praktikat e pajtimit; disa shtete e kan\u00eb adresuar k\u00ebt\u00eb duke krijuar Komisione p\u00ebr t\u00eb V\u00ebrtet\u00ebn (El Salvador, Kongo dhe Kenia), Komision t\u00eb Unitetit dhe Pajtimit Komb\u00ebtar (Ruanda), Komision p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin (Afrika e Jugut, Kanada dhe Kosova).<\/p>\n\n\n\n<p>N\u00eb Kosov\u00eb, Komisioni p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin u krijua n\u00eb vitin 2017; ish-presidenti Hashim Tha\u00e7i inicioi krijimin e nj\u00eb Komisioni p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin (TRC) n\u00eb Kosov\u00eb p\u00ebr t\u00eb ndihmuar n\u00eb sigurimin e baz\u00ebs p\u00ebr dialog midis komuniteteve t\u00eb ndara t\u00eb Kosov\u00ebs. TRC-ja kishte p\u00ebr q\u00ebllim t\u00eb vendos\u00eb fakte rreth luft\u00ebs s\u00eb fundit n\u00eb Kosov\u00eb, t\u00eb mbroj\u00eb viktimat dhe t\u00eb mbijetuarit dhe t\u00eb mb\u00ebshtes\u00eb ndryshimet e politikave t\u00eb Kosov\u00ebs n\u00eb lidhje me aktivitetet e pajtimit. Para k\u00ebtij vendimi, institucionet e Kosov\u00ebs,&nbsp; gjegj\u00ebsisht qeveria e Kosov\u00ebs n\u00eb vitin 2012 themeloi t\u00eb ashtuquajturin &#8220;<strong>Grupi Punues Nd\u00ebrministror p\u00ebr Ballafaqimin me t\u00eb Kaluar\u00ebn dhe Pajtimin&#8221;<\/strong>.&nbsp; Ky grup punues u mandatua t\u00eb merret me shkeljet e r\u00ebnda t\u00eb t\u00eb drejtave t\u00eb njeriut dhe shkeljet serioze t\u00eb s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare humanitare n\u00eb t\u00eb kaluar\u00ebn n\u00eb Kosov\u00eb, p\u00ebrfshir\u00eb luft\u00ebn e fundit dhe periudh\u00ebn e tranzicionit. Nd\u00ebrkomb\u00ebtarisht, \u00ebsht\u00eb e qart\u00eb se komisionet p\u00ebr t\u00eb v\u00ebrtet\u00ebn jan\u00eb m\u00eb efektive kur integrohen n\u00eb nj\u00eb strategji gjith\u00ebp\u00ebrfshir\u00ebse t\u00eb drejt\u00ebsis\u00eb tranzicionale q\u00eb p\u00ebrfshin politikat e kompensimit, ndjekjet penale dhe reformat institucionale. N\u00eb rastin e Kosov\u00ebs, nuk \u00ebsht\u00eb e v\u00ebshtir\u00eb t\u00eb konkludohet se pajtimi \u00ebsht\u00eb larg pa drejt\u00ebsin\u00eb e duhur tranzicionale, politikat e kompensimit dhe ndjekjet penale. Iniciativat p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin jan\u00eb komplekse dhe sfiduese. P\u00ebr t\u00eb qen\u00eb t\u00eb suksesshme, ato duhet t\u00eb planifikohen dhe krijohen n\u00eb m\u00ebnyr\u00eb adekuate q\u00eb t\u00eb mos thellojn\u00eb ndarjen ose t\u00eb lejojn\u00eb konfliktin e mundsh\u00ebm midis pal\u00ebve. P\u00ebr t\u00eb qen\u00eb t\u00eb suksesshme, k\u00ebto nisma dhe komisione duhet t\u00eb jen\u00eb t\u00eb paanshme, pjes\u00ebmarr\u00ebse, t\u00eb ken\u00eb ndjeshm\u00ebri t\u00eb konsiderueshme, t\u00eb jen\u00eb neutrale dhe t\u00eb shikojn\u00eb pajtimin me nj\u00eb qasje gjith\u00ebp\u00ebrfshir\u00ebse. Kjo gj\u00eb \u00ebsht\u00eb qen\u00ebsore q\u00eb k\u00ebto komisione t\u00eb mos shnd\u00ebrrohen n\u00eb forume ku nj\u00ebra pal\u00eb konsiderohet viktim\u00eb, e tjetra agresor. Politikat ekzistuese t\u00eb pajtimit duhet t\u00eb p\u00ebrmir\u00ebsohen duke e b\u00ebr\u00eb politik\u00ebn e pajtimit m\u00eb p\u00ebrfshir\u00ebse dhe transparente.<\/p>\n\n\n\n<p>&#8220;Pajtimi \u00ebsht\u00eb proces shpirt\u00ebror i cili k\u00ebrkon m\u00eb shum\u00eb se nj\u00eb korniz\u00eb ligjore \u2013 Mandela.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-text-align-center\"><em><span style=\"color:#13c1cb\" class=\"has-inline-color\">\u201cKy artikull \u00ebsht\u00eb mund\u00ebsuar me mb\u00ebshtetjen e YIHR KS si partner implementues i Agjencis\u00eb s\u00eb Shteteve t\u00eb Bashkuara p\u00ebr Zhvillim Nd\u00ebrkomb\u00ebtar (USAID).
